terms of service

By making a purchase, the Purchaser acknowledges and agrees to abide by these Terms of Service.

General Usage

My artwork is not free to use and may only be used by the owner.
You may use the character design as your OC (Original Character) with proper credit: “Character Design by Sakuraskyes.”
You may not reupload the virtual product unless you are the rightful owner of the piece.

Watermarks

To ensure the authenticity and ownership of my artwork, I include two types of identification.
Required Text: Each piece includes a prominent, decorative nickname or username to identify the owner and ensure authenticity
Optional Watermark: A small, translucent text with the owner's username is added to the top and bottom of the artwork to verify ownership and prevent unauthorized use.

Payment Policies

Full payment is required to be sent first.
I only accept payment through PayPal invoices.
Payment must be made within 24 hours. However, I may agree to hold your piece for up to 72 hours upon request.
Failure to pay will result in the piece becoming available for sale again.
Holds must be requested in the initial claim/bid post.
Refunds are only available if the commission hasn't started or an incorrect payment amount was sent.
Dual Ownership: This option allows two individuals to co-own a piece, with shared rights and responsibilities. Both owners must split the payment however they wish but two forms of payment are required. Please contact me for more information.
Any chargebacks or disputes will result in immediate cancellation, the piece becoming available, and a single warning.Upon a second chargeback the buyer will be blacklisted.

I retain all copyrights to my artwork, including the right to post WIPs and finished pieces as part of my portfolio and for self-promotion.
Commercial use is x3 the price.

Work In Progress and Revisions

WIP's may not be preclaimed.
Two WIPs will be sent during the initial painting stage and the detailing stage.
Big Revisions: Significant changes, such as expression or pose adjustments, can only be made during the initial painting stage.
Estimated Time of Arrival (ETA): The completion time for your commission will range from 4-12 weeks, depending on the piece's complexity, size, and my current workload. I will notify you if unforeseen circumstances arise extending the ETA.

Payment Plans

Payment plans are available for pieces $150 USD or more.
Installment Options:
_{Weekly: $50 usd/week}
_{Bi-Weekly: $100 usd/every 2 weeks}
_{Monthly: $200 usd/month.}
All invoices will be sent and scheduled upon agreement of the payment plan.
A non-refundable down payment of at least $50 USD must be sent within 25 hours. Failure to do so will forfeit the piece to the next highest bidder.
Failure to complete the payment plan within the agreed timeframe will result in two consequences:
_{A full refund, excluding the non-refundable down payment.}
_{The piece will become available for purchase again.}

Commission Policies

To secure your commission, please submit your form as soon as possible and make the payment within 24 hours of receiving the first WIP.
I will not edit a piece after the final piece is agreed upon and sent.
No rushed commissions.
Commissions will be completed in order of the form submitted.
I reserve the right to decline a commission if I feel uncomfortable painting the desired content.
I will not paint anything that is not in one of my styles.

Claiming and Auction Rules

Premade claims are based on a random selection, determined by spinning a wheel unless three people claim within one hour of the post. In such cases, the piece will be converted to an auction.
The auto-buy will be revealed 8 hours into the auction.
Auctions end 48 hours after the first bid is placed.
If a bid is placed within the final 10 minutes, the auction will be extended for another 30 minutes.

Restrictions

Do not use my artwork for 3D models, VRChat, or NFTs.
Tracing, copying, editing, and removing text/watermarks of my artwork is strictly prohibited.
I retain the rights to revoke ownership of all my artwork (premades, commissions, and adoptables) at my discretion.
You must wait 30 days after your purchase from me to resell any of my artwork.

Bidding Conduct

ALWAYS reply to the bidder above you in the thread. Private/DM bids will not be accepted.
Only participate in auctions or claim pieces if you intend to complete the purchase. Non-serious bids or claims may result in a cooldown or ban.
1st Instance: 7-day cooldown.
2nd Instance: 30-day cooldown period.
3rd Instance: a permanent ban from claiming or bidding on pieces.

Retexts, Trading, and Resell Rules

Resell only for the same price or lower.
Text changes cost $10 USD after the initial purchase. Payment can be sent here: paypal.me/sakuraskyes. Attach a screenshot as proof of payment and include a picture of the artwork for easy identification.
